Australian dollar heads lower in currency trading

Aussie is losing ground in forex trading today, dropping as risk aversion sets in. The Australian dollar is down in currency trading as concerns about global economic growth hold back a number of currencies and other riskier assets.

US teen guilty of murdering 2 British tourists

SARASOTA, Florida?? A Florida teenager is facing a life sentence after a jury convicted him of first-degree murder Wednesday in the shooting deaths of two young British tourists last April, a case that generated blaring tabloid headlines in the U.K. press.

Shawn Tyson, 17, sat stone-faced as the jury's verdict was read and as two friends of the victims spoke angrily about the crime. The verdict came after two hours of deliberations. Because he is under 18, Tyson is ineligible for the death penalty and is facing a mandatory life sentence.

During the trial witnesses testified that Tyson shot James Cooper, 25, and James Kouzaris, 24, last April 16. The two men were vacationing in Sarasota and spent an evening drinking when they got lost and walked into a housing project where Tyson lived. Details of their deaths have gripped the British news media. Tabloids there have written stories saying the men were "slaughtered" in a Florida "ghetto."

In a statement, the families of Cooper and Kouzaris accused Tyson of being "evil," saying that they had been given "a life sentence when our sons were so brutally and needlessly taken from us. Ours is a life sentence, with no chance of parole from a broken heart, and a shattered soul."

Joe Hallett, a friend of the victims who sat through the entire trial, said the pair befriended people from different walks of life and would have tried with Tyson, as well.

"I have to try to make you understand the pain you brought to so many people," Hallett said to Tyson. "It was through your deadly action that you've taken us all on a journey to hell. Every night before you go to sleep, every morning you wake up, I want you to think of my friends who were murdered."

A prosecutor also read a statement from Cooper's parents and played a video at the request of his parents. The video, which portrayed the young man from the time he was born, was also played at his funeral.

Kouzaris was from Northampton and Cooper was from Hampton Lucy, Warwick. Both were considered fun-loving world travelers by friends -- but also smart and cautious. Authorities said both were drunk when they got lost and wandered just before 3 a.m. into the housing project where Tyson lived.

Witnesses testified that Tyson told them he saw two "crackers" -- his phrase for white people -- walking through the neighborhood and that he intended to rob them. The tourists said they didn't have any money and begged Tyson to let them go home. The men also told Tyson that they were lost.

"Since you ain't got no money, then I have something for your ass," Tyson recounted to a witness, then added that he shot the men several times.

The tourists' bodies were found shirtless on the street and their baggy pants were pulled down to their thighs. Both men still had their wallets and did in fact have money; Cooper also had a cellphone and camera in his pants pocket. Authorities later found that Kouzaris' blood alcohol level was 0.243 and Cooper's was 0.214 -- well past Florida's legal limit for intoxication when driving, which is 0.08.

'An opportunity to rob and kill'
During closing arguments, Assistant State Attorney Ed Brodsky told the jury that the case was about "opportunities."

"For James Cooper and James Kouzaris, they had seized an opportunity to travel abroad," Brodsky said. "Shawn Tyson seized upon an opportunity to rob and kill two men."

In the end, Tyson was his own undoing. Several prosecution witnesses said Tyson told friends about the shootings in the hours after the killings, then asked friends to hide the murder weapon and bury bullets. A DNA expert said Tyson's skin cells were found on Cooper's jeans.

Tyson maintained to police that he was at home during the murders. But witnesses spotted him crawling into his window shortly after hearing gunshots.

Tyson did not testify. His attorneys called only one witness, a crime scene technician, and questioned him briefly. Defense attorneys also tried to discredit the witnesses by saying many of them had criminal records and cooperated with detectives to avoid jail time.

The defense also said no one saw Tyson shoot Cooper and Kouzaris.

Authorities say Tyson wasn't alone the night of the shooting; police have not charged the second suspect because they don't have enough evidence. That person is currently in prison on unrelated charges.

Paul Davis, another friend of the men who attended the trial, had another message for Tyson.

"You might think that being a man is about carrying a gun, but it isn't," Davis said. "The stupid thing about what you've done is that you've ended your own life."

James Cameron completes risky Mariana Trench dive

Filmmaker James Cameron completed his trek to the Mariana Trench today, resurfacing after reaching a depth of approximately 7 miles under the water's surface. The dive was part of a National Geographic expedition to collect samples from and learn more about the poorly studied Pacific Ocean trench, the deepest on Earth.

Cameron made the expedition in a small submarine named the Deepsea Challenger. The sub is rated to withstand the intense pressure of the Mariana depths ? a full eight tons per square inch. Because any error in the sub's design could lead to it being crushed, the craft, designed by Cameron himself, was sent to the Mariana Trench on a unmanned trial run last week.

This is not the first time Cameron has been in a sub, of course. The director has participated in 72 dives, 12 of which were for the movie Titanic.

Having previously looked at rumours about girls? schools, here we have goo Ranking looking at the characteristics of men educated in boys? schools.

Demographics

Between the 17th and 18th of January 2012 1,048 members of the goo Research online monitor group completed a private internet-based questionnaire. 61.6% of the sample were female, 12.3% in their teens, 15.6% in their twenties, 27.9% in their thirties, 25.8% in their forties, 9.5% in their fifties, and 8.9% in their sixties. Note that the score in the results refers to the relative number of votes for each option, not a percentage of the total sample. This survey was presumably for the women only.

North Carolina PG Marshall won't play against Ohio

ST. LOUIS (AP) ? North Carolina will have to do without dazzling point guard Kendall Marshall for Friday night's Midwest Regional semifinal against Ohio.

The top-seeded Tar Heels announced about 90 minutes before the game that Marshall will not play because of a broken right wrist. Freshman Stilman White, who has played a total of 136 minutes in 36 games, replaced Marshall in the starting lineup.

"We are still Carolina Basketball," Marshall said on Twitter, adding the hash tag "RiseAsOne."

Marshall is averaging about eight points and 10 assists for the Tar Heels (31-5) in the Midwest Regional. He has scored in double figures for six straight games and has been the team's most irreplaceable player at the helm of its fast-paced attack.

The Dumfries, Va., native is a second-team all-Atlantic Coast Conference pick who has 351 assists in 36 games, the best season total in league history and fourth most in NCAA history.

The left-handed Marshall broke his right wrist Sunday when he was fouled on a drive against Creighton. He had surgery Monday to install a screw in the wrist and got his cast off Wednesday. Though Marshall said Thursday the wrist was improving with each day, he said his range of motion would have to get better and the pain would have to decrease for him to be able to play.

"Whether I'm playing or not, it's not going to matter. Carolina basketball is still going to go on," Marshall said Thursday. "They can be successful without me."

White began the year as the Tar Heels' No. 3 point guard, not expecting to get significant playing time. But he became Marshall's primary backup after Dexter Strickland suffered a season-ending knee injury in January. While has played in all but four games, averaging less than a point in 4.3 minutes of play.

The Tar Heels have won 10 straight in the regional semifinals. Thirteenth-seeded Ohio (29-7) is only the seventh team seeded 13th or higher to make the regional semifinals and first since Bradley in 2006. None of the teams won its next game.

This one is much more qualitative and thus harder to measure success vs. failure so I gave myself a wishy-washy grade.

Motherhood
Original intention:? fun. I want to infuse my home and family with love and laughter
Grade: B

This deserves a B because I am consciously working on it, but far from perfect. When things start to go awry (in that every-day sort of way, when nothing is really wrong, just whinier, jumpier, and grosser than I'd like), I remind myself to "just have fun".? Distraction is a good technique for dealing with kids & adults alike (just ask a certain political party....).? And saying "Yes" more often isn't going to turn my kids into deviants.? I mean, doesn't music, crackers, or a sticker make?everyone's life a little brighter?

My enemy in this is also my dearest ally---my to-do list. There are definitely times (weekday evenings specifically) where I shove aside fun to plow through my chores. I miss my boys all day yet when we all get home I half-ignore them as I rush here & there making lunches, washing bottles, and starting laundry. Sure, all of this can be done after they go to bed but that end-of-the-day alone time is so so precious to me that I try to maximize it by completing the must-dos earlier in the evening...at the expense of giving my full attention to my children.

So I'm going to add to this intention---my motherhood goals will include having fun and focus. And the to-do list gets put on hold from 6-8 pm.

Beelzebub's Broker: Bring me Cordelia! (review of "Bright-Sided")

Positive thinking has become so integrated into the value system of our modern culture, it might seem somewhat odd to find an argument against it. And yet that is exactly what Barbara Ehrenreich does. The release of this book, which was published as ?Smile or Die? in the UK has corresponded with the publication of more bold books, willing to challenge the power of positive thinking. A little while back I read Steve Salerno?s unrelenting attack on the self-help movement, ?SHAM: How the Self-Help Movement Made America Helpless? and since then we have had ?The Art of Failure: The Anti-Self Help Book? by Neel Burton. Even the great psychologist Richard Wiseman has taken positive thinking to task and looked at the real science behind self-help in ?59 Seconds?, which came out the same year as ?Bright-Sided?. This book was not an overt criticism of the self-help movement but rather a genuine attempt to use case studies, raw data and proven psychological methods to help people improve their lives. However, in keeping to the science Wiseman highlighted just how much of the self-help movement was bogus and even damaging. His first chapter, ?Happiness?, began with a total debunking of positive thinking and revealed that far from being innocuous at worse, these techniques endorsed by the vast majority of the self-help movement could actually be harmful.

However, out of all these books Ehrenreich?s ?Bright-Sided? seems to be the most comprehensive and distilled in its deconstruction of the whole philosophy of positive thinking. She begins with her first clash with the cult of positive thinking after being diagnosed with breast cancer in around 2001. Ehrereich?s award winning ?Welcome to Cancerland? article, which was published not long after she started receiving treatment, demonstrated the writer?s annoyance with the whole positive industry surrounding victims of cancer. The article inspired several people to question the so-called empowering methods being employed at all levels of cancer care and support. It even inspired the 2011 documentary ?Pink Ribbon Inc.?, which further explored the exploitative industry of those who were supposedly trying to help victims of the disease.

In ?Bright-Sided? she has far more space to go through her own personal experiences on forums and support groups, which led her down the path of investigating the whole nature of positive thinking. Ehrenreich noticed that not only were pseudoscientific products and ideas being hawked to help strengthen a patient?s immune systems against cancer on the back of positive thinking, but also that positive thinking was putting extra pressure on some victims of the disease. Worse still, terminal cancer patients were being made to feel they had somehow failed. Ehernreich noted the perverse extremes the philosophy of cancer support gurus who told ?survivors? to be thankful for their cancer. Working through restriction and seeing opportunities through bad situations is all well and good, but that is a world apart from thinking that being affected by a disease like cancer is somehow a blessing!

America, as the author, notes in her prologue, is a country known for its positive attitude. The sign-off ?Have a nice day!? and perpetual ivory white smiles are the trademark of the nation. Whereas Britain had the stereotyped stiff upper lip in the face of adversity, their cousins over the Atlantic did much more than stare down their problems with calm and a dry sense of humour, they ?embraced it? with open arms.?

Looking outside ?Cancerland? Ehrenreich?s attention was drawn to the way positive thinking had become a part of the very society lived in and had gone on to infect the rest of the world. I was particularly interested in the way traced this national philosophy back to the USA?s Christian roots. Positive thinking has a distinctively puritanical hard work ethic at its core, which the author linked back to Calvinism. She then traces how it evolved through the emergence of American religion such as Christian Science and the 19th century mystical idea that people could be healed through thinking in a certain way.

Ever the anti-capitalist, it would have been out of character for the author not to have picked up on the way materialism became part of the whole positive thinking fad as it took hold of America?s value system. Suddenly doctrines in Christianity that saw the virtue in poverty and humility were replaced by the idea that God wants Man to prosper. To be a successful and wealthy businessman went hand-in-hand with being a good Christian. Positive thinking, Ehrenreich argues fuelled the mega-churches and the rise of evangelism. The obvious attraction of enthusiastic and happy people ? genuine and otherwise ? meant that such institutions would be successful.

Of course, American Christianity, as powerful and hugely influential as it is, does not have a monopoly on positive thinking as a method or ethic. The book makes a strong point that the allure of the attitude easily permeated the New Age movement from its earliest beginnings. Deepak Chopra and others fully endorse the mind over matter ideas that first became popular in 19th century America. This has allowed the gateway to open for all sorts of spiritual marriages with the acquisition of wealth.? Concepts like cosmic ordering and the law of attraction, championed by the bestselling pseudoscientific book ?The Secret? by Rhonda Byrne, straddles New Age spiritualism and secularism with ease.

It is with the idea that positive thinking is just a given to be good for you, Ehrenreich makes the case that its misuse is responsible for the fall of businesses and a strong component in the Subprime Mortgage Crisis and global recession of the late 2000s. She has a good argument that compliments the cognitive dissonance/self-justification theory illustrated in Carol Tavris?s ?Mistakes Were Made (But Not By Me)?. Looking at it both we see an interesting picture of self-justification and refusal to accept personal error or responsibility fueled by a culture of ?yes men?. The ?yes men? element, of course, comes from Ehrenreich. Many large corporations have adopted a policy of firing advisers who were not positive enough. This type of delusion led employees of banks and businesses to refuse to listen to those who erred on the side of caution or presented a picture that was anything less than positive for the future. What seems to key in Ehrenreich?s critique is the way that overzealous positivity prohibits the voices of reason. To not be positive has become a sin. And yet this has not always been so. There are plenty of fables that praise the person who is willing to stand against madness, delusion and flattery to deliver the hard truth. My favourite is Cordelia from Shakespeare?s ?King Lear?. The youngest of the abdicating old king?s daughters refuses to follow the flattery of her sisters, Goneril and Regan. They have competed for their father?s affection in public in order to be given the biggest portion of the kingdom as possible. They play to his vanity. Cordelia, Lear?s actual favourite, will not do anything but tell her father the truth. Lear ends up banishing her and suffers the consequences when his elder daughters reveal the true, cruel and ruthless natures. Cordelia, it is argued by many is also replaced The Fool, Lear?s court jester, who continues to remind the king of his follies and his errors of judgment. The truth is that every great leader needs their Cordelia. They need the person who has the strength and cares enough to tell the truth.?

The audiobook production is straightforward and slick. There are no whistles and bells, as befits the tone of the book. My only criticism is that Barbara Ehrenreich might not be to everyone?s taste. I get her dry humour and delivery, but a fellow listener commented that it sounded a little robotic. This is a problem with a lot of members of the sceptical movement. They might be witty and articulate, but that cold logic they bring to their subjects can permeate into their delivery, making them less appealing to the middle ground. It is a small observation and I reiterate that it didn?t spoil my enjoyment of the work.

?Bright-Sided? is a sobering and bold piece of non-fiction. I believe it opened the floodgates for more works that have dared to challenge impractical, exploitative and delusional concepts at the very core of modern society. This is coming from someone who counts life-coaches and self-help counselors among his friends. I even wrote a forward for a delightful collection of motivating essays written by a dear friend who is an incredible positive thinker. I don?t think that we should be deeply cynical about those who motivate us or tell us to think positively and neither does Ehrenreich. We may have some interesting arguments for applied pessimism in recent non-fiction books and perhaps nihilism will make a return to the fore in the wake the damage over-the-top optimism and unrealistic idealism has done to the financial factor. However, Ehrenreich is not putting the case for an opposite approach to positive thinking. Her final chapter, her postscript in fact, is perhaps the best piece in the entire book. Unlike Salerno?s ?SHAM?, Ehrenreich acknowledges that the reader needs some sort of alternative solution to unrealistic and unchecked positive thinking. She looks at the way pessimism can be applied practically without destroying ambition and how science enables us to best understand the way the world works. She argues for a sense of proportion, balance and realism.

FOSS Patents: German appeals court lets Motorola continue to ...

For a significant period of time (which could be a year or more), Motorola gets to continue its enforcement of a German patent injunction that obligated Apple to deactivate the push notification feature of its iCloud and MobileMe service offerings for customers using those services in Germany.

A spokeswoman for the Karlsruhe Higher Regional Court (the appeals court for the circuit the Mannheim Regional Court belongs to) just confirmed to me over the phone that an Apple motion to suspend the aformentioned enforcement was denied. The denial was ordered on Wednesday (March 14).

Subsequently, Motorola issued this statement: "We are pleased with [Wednesday's] ruling in Germany denying Apple's motion to stay the injunction related to our push email patent. We will continue to protect our intellectual property."

This afternoon, Judge Andreas Voss of the Mannheim Regional Court (who presides over most of the smartphone litigations pending at that court, including all of the ones involving Apple) mentioned that decision by the appeals court at a hearing on a lawsuit in which Motorola Mobility is asserting the same push notification patent against Microsoft. (With all that's going on here, and due to many hours spent in courtrooms in Munich and Mannheim, I have a backlog of three German patent trials to report on, including that one.)

The push notification patent is not a FRAND-pledged standard-essential patent. In a different matter, Motorola won and temporarily enforced an injunction over a patent essential to GPRS, the mobile Internet extension of the GSM wireless standard. But the enforcement of that particular injunction was suspended by the Karlsruhe Higher Regional Court, initially for a few weeks and subsequently for the duration of the appellate proceedings, which will probably take well over a year, if not two years. That suspension was based on an amended version of Apple's FRAND defense. But against the push notification patent, there is no FRAND defense. Based on what Apple announced after the related injunction was ordered in early February, I presume that Apple's motion for a suspension was primarily based on its invalidity contentions (though I believe Apple additionally contested the Mannheim court's finding of infringement).

In the push notification case, the appeals court apparently wasn't convinced of Apple being more likely than not to succeed with its appeal. I hope to see the ruling soon so I can tell whether the technical issues Apple raised just didn't lend themselves to a motion for suspension of enforcement (simply for being technically too complicated) or whether the appeals court has serious doubt about the merits of Apple's appeal.

At any rate, the denial of Apple's motion for a suspension of enforcement in this case underscores the significance of Apple's ability to win a suspension in the standard-essential patent case. There were some people who never tried to find out about the specifics of German patent litigation but nevertheless claimed that suspensions of enforcement were pretty much a routine thing here. I have previously said that such suspensions are granted only under extraordinary circumstances (such as Apple's strong FRAND defense). This week's denial and the earlier denial of Apple's first motion to suspend enforcement of the standard-essentia patent injunction (only the second such motion succeeded) should convince all those who believe such suspensions are low-hanging fruit in Germany.

I just mentioned that Apple needed a second motion to get the enforcement of the standard-essential patent injunction suspended. But a second motion for suspension can't succeed unless it raises new issues that weren't previously considered. In the FRAND case, Apple amended its licensing proposal, which it was free to do anytime. In the push notification case, Apple is not too likely to come up immediately with new facts warranting reconsideration. Apple has presumably presented all of the arguments it has at this stage. Favorable developments in an ongoing nullity action against that patent could persuade the appeals court to take another look and, potentially, grant such a motion. I don't know the schedule of the nullity action, but there'll be significant intervals between any written opinions or decisions.

While the standard-essential patent injunction affected Apple's ability to sell certain products, the push notification injunction only causes a certain amount of inconvenience to some of Apple's customers who live in or travel to Germany. If Apple had gotten to pick one of the two cases to be suspended, it would not have hesitated for even one second to pick the FRAND case, not the push notification case. But even the push injunction means that Motorola's patent enforcement is for the time being having more of an effect on Apple's business than the other way round. Apple won two German injunctions against Motorola, one over certain slide-to-unlock mechanisms and another one over a page-turning feature of the Android photo gallery (in zoomed-in mode), and while those affect the user experience in my opinion (Motorola unsurprisingly disagrees), they aren't devastating, especially in light of the fact that Motorola's German business isn't huge (while Apple's clearly is).

Google is in the process of acquiring Motorola Mobility. Observers expect the deal to close soon, possibly within a matter of weeks. At this week's German trials involving Motorola, a high-ranking Google inhouse lawyer and a member of her IP litigation team were in the audience. It's possible that Google lawyers previously attended German Android-related trials, but this was the first time that Google had a noticeable presence in the courtroom. Google is certainly looking to build leverage against Apple and Microsoft through court rulings in Motorola's favor, particularly in Germany, where certain courts move fast and the overall legal framework and mentality favor the interests of patent holders.

The push notification patent, even if enforced for several more years, won't force Apple to settle with the entire Android ecosystem on Google's terms. But Motorola has many more patents, and Google acquired thousands of patents from IBM and other sellers last year. There is potential for more litigation. However, Google's acquisition of Motorola also makes any German patent rulings in Apple's and Microsoft's favor more valuable: Google is a global player and will have ambitious plans for Motorola's German business, given the size of the market.

Fuel poverty seen for 3 million households by 2016

LONDON (Reuters) - Up to 3 million British households will be in fuel poverty in 2016, a government-commissioned report forecast on Thursday, showing that the UK's goal of eradicating fuel poverty by then could be at risk.

Professor John Hills at the London School of Economics calculated that 2.6 million to 3 million households will be fuel poor in four years' time, meaning the money they have left after paying energy bills will leave them below the official poverty line.

Britain has a legally binding target to eradicate fuel poverty as far as reasonably practicable by 2016, but the report forecast that the number of fuel poor households could rise from the current 2.7 million.

Hills said the government's definition of fuel poverty - households which spend more than 10 percent of their income on energy bills - is flawed because it does not accurately reflect the extent and depth of the issue.

Hills called for the government to use a new, more detailed indicator called Low Income High Costs (LIHC).

"When one focuses on the core of the problem in the way I propose, the outlook is profoundly disappointing, with the scale of the problem heading to be nearly three times higher in 2016 (...) than in 2003," he said.

Following the publication of the report, Energy and Climate Change Secretary Edward Davey said he would adopt a new definition to measure fuel poverty by the end of the year and publish a consultation on the new approach this summer.

"The evidence is overwhelming that improving the way we measure fuel poverty is integral to delivering the right policy outcomes," he said in a written ministerial statement on Thursday.

The extra amount of money that fuel-poor households have to pay on energy bills compared with higher income households will rise to 1.7 billion pounds in 2016, more than 50 percent above what was paid in 2009, Hills said.

This means fuel-poor households will have to pay on average 600 pounds more per year than better-off households.

Poor households face additional costs because they typically are unable to benefit from paying by direct debit and other methods that trim bills.

The report also showed that 75 percent of low-income households lived in buildings rated at a poor energy-efficiency level (E, F or G), meaning these households have to spend more money on keeping warm.

Hills recommended the government set out a strategy to tackle fuel poverty, saying improving energy efficiency in low-income households would be the most effective measure to reduce fuel poverty.

Britain's Fuel Poverty Advisory Group also urged the government to act.

"The Government must grasp the nettle and use carbon tax revenues to increase the help available for the households hit hardest by rising energy bills," said Derek Lickorish, the group's chairman.
